A $45 million Direct Response Consumer Products company. It sold products directly to consumers through the use of various media.

The Challenge

As a result of declining profitability, litigation with former partners, and FTC investigations, the Company sought protection from creditors under Chapter 11 of the U.S. Bankruptcy Code.

The Solution

Engaged to serve as the Company’s financial advisor to assist it with managing the bankruptcy process, developing forecasts, assisting with the development of a plan of reorganization and disclosure statement, and to assist with negotiating with the various parties of interest in the Company. The emergence plan called for the majority owners of the Company to retain a significant portion of the equity in the emerged Company and resolving the ongoing government and litigation issues. The Company emerged with new equity capital and an opportunity to rebuild its franchise.
